Can somebody please throw some light on this issue.
I have an approved H1extn till 2013 but I had moved to the new location and new project since then but I don't have a new LCA. And now when I'm planing to go to india and appear for visa stamping I don't have the new LCA for my current location.
When I asked my lawyer, she said that I need to apply for fresh H1 extn. This doesn't make sense to me, Can I only get new LCA for my new project location ?
Do I need to get my H1B amended with this change ?
Please help me on this ...

Spoke to Virgin Atlantic cust rep last week for flight from US to India via London and they said they cannot accept Advance Parole for transit and I would need UK Transit Visa or Valid US visa.

Hi folks,
Have a question? Will it be possible to change from EB-2 to Eb-3 with in the same company. My PD is Nov 02 with I-140 just now approved. Or do i have to find another job in some other company in order to use old priority date. Pl. advise is this the right time to change or wait for EB-3 to be current for my PD(don't know , lost hope as of now)

Yes, it is possible if you qualify for eb2 in the same company, lawyers can help you with it if you qualify.

I was among the randomly selected people for DV 2009. Currently I am in US with F-1 visa. I learned that I am eligible for Adjustment of Status. Do you think it is reasonable to process my files in US or should I go back to my country?
What kind of documents should I fill in? Also I need to pay the filing fees (for I-485 $930 for example). Are there any other costs? I also read that there is a medical examination report, how much could it cost to me?
So after reviewing everything what will be the best decision for me? I asked an attorney but he didn't have enough of experience to help me, and I can not afford one more attorney.
I will be thankful if somebody could enlighten me on these.

thx for ur inputs newbie2020. yes, i know that it is a conditional GC to start with.
my concern was - as far as i know, i cannot work actively for my own business on H-1B. hence i wanted to know if i could continue working on H-1B, apply for GC under EB-5 and then start the business after getting it.

Sorry for the confusion. i am not deported. One of my company's new employee was deported at POE. Yes. POE did called my employer and asked where he is going to work. My employer said he is going to work on our company site. Then the officer said your empoyee told us that he is going to work at client site. Then the officer said he will call back.
Officer called back after 30min and told my employer that your emplyee submitted some fraud document. And then my employer said i am not liable what he did and explined the officer that he was doing bussinees more than 8 years and have all the proper documents.
Then the officer said he understand the situation and said he is just doing duty. Officer said he is going to send a report to DOL.

I had an EAD (OPT) soon after I completed school in 1999 and after that I switched to H1B. I am now considering filing an EAD: Should I file a New or a Renewal EAD? Thanks.

Hi Gurus,
My wife has her H4 Visa stamp until 1st Oct 2010. She is in India. I am planning to visit India and travel back with her. If my visa gets stuck in "Admin Processing" will my wife be able to travel back on her valid H4 Visa.
She has to travel back due to some personal reasons.
Please advise.

yes, She will be able to return back as long as you both dont go for stamping together. If you get stuck in Admin Processing then they will cancel her current visa until you get your visa since she is dependent on you.
So the best thing to do is, you go for stamping first and if it works out for you then let her go for stamping afterwards or She can enter using her current visa and then file an extension before it expires.

thanks for the info. Since he got I 485 approved the GC status already began for him or only on receipt of GC his Green card status begins.

before my I-485 status "runs out" ?
My PD is June 2005/EB2. I am a July 2 filer. I have received I-485 receipt,EAD and AP.

If your current employer is your GC sponsor, won't he withdraw its I-140 if you quit? As I-140 is for future job, if you and him continue to have intent of making employee/employer relationship as per filed I-140, you can do whatever you want in the meantime, but you would need to work for him on getting your GC. Or you can wait and hope that I-140 is not approved within 180 days. In that case you can move to the new employer. Employment with sponsoring employer prior to GC approval, paystubs, etc. are only for establishaing and restrengthening expressed intent.
