Mmmm, doesn't have a lot of stumpiness. I mean. I can see the stump, and there's nice light, but the bottom of the stump is dark, and the shape isn't defined as a stump. I think a different wider angle making the stump more obvious in it's surreoundings, or a tighter shot for an abstract pattern/texture might have worked better. I can see why you composed it as you did, there's nice light/dark balance overall, but there is no particular focal point for the eye and that leaves you sort of wandering when you look at it. My opinion, your mileage may vary...

I have a question regarding Multiple I-140s.
I applied for I-140 (PD: 2006) and it got approved in 11/2006;
I applied for LC-sub (PD:2004) and it is pending with USCIS
I applied for 485 in July 2007, My question is which PD will USCIS consider? Does it take the one with approve I140 or the pending one ? form 485 does not show the PD anywhere.

Occupations on Job Zone 5 are listed here: Job Zone Five: Extensive Preparation Needed (http://online.onetcenter.org/find/zone?z=5&g=Go).
Even if the position is not in this list, the employer can still require EB-2 requirements. It just means that the company will have to answer "no" to the question on the PERM form as to whether the position requirements are normal for the occupation. This may trigger an audit where the company will have to justify the extra requirements based on business necessity. I've done this many times without a problem. I'm not saying it is easy, but if the employer has detailed business reasons for the requirements, it should succeed.

My parents are going back to India in April'10 just before completion of their 6 months. But they want to come back again after 3 weeks. They have got their visa for 1 year. So they can stay another 4 months on their 2nd trip from May'10 to Aug'10.
Is it going to be a problem during their next visa stamping or immigration at airport as they will end up staying 10 months in US out of their 1 year approved visa ?
Please advise.

You can try filing a FOIA request with USCIS and ask them to give yo information. It will take lot of time though. Immigrationvoice filed FOIA request last year and now USCIS shows all EB data to everyone.

My friend will come from India on H1B first time to Atlanta Air port this weekend. His H1B was approved for year 2008 and his stamping was done in early 2009. His H1B is from small desi consulting company. What kind of questions he may face? Any inputs will highly appreciated.
One of the most common questions for situation your friend is in is why he waited this long to come to the US after approval of H1B visa. Another question is to show proof of job availability. It is 2 years since a petition was applied for him and a year since he got his visa. Unless he has some very solid answers, there is a possibility that they might deny his entry.
If you say that another position has opened up for which he is coming, then the next question would be if a new LCA was applied for the new position, which would then open up a totally new ball game. I would suggest that you have your friend contact his company lawyer for suggetions, rather than listen to advice given by people here who have not been in such situations.

no it doesnt....check on ..there are so many people getting consecutive luds...but then they dont get approvals. in the end it means that its a new lud. someone accessed your case and the lud was either because some accessed it or it was a system generated lud.
i hope that eb2-june03-dude gets his green soon...but the lud doesnt mean anything

While the article specifically mentions naturalization applications, it does not clearly limit the recommended increase only to this application. Could anyone tell me when the PD is exactly ported.
1. I filed my labor thorugh location A for a company. Then the company moved me to location B within the same state.
2. My company attorney asked me to refile the labor sicne the location is changed. I did and get it approved.
3. In the mean time, I got my location A labor cleared. So to port the PD, i asked the company to file 140 for location A. They did and it get approved.
4. Now I filed the 140 for location B.
I did not see at any place in the second 140 mentioning about my previous PD . How and when exactly the PD is considered ported?

Dec. 06 expired a lettler that USCIS send to my employer but we never received the lettler, it was a wrong information for the address my boss was talking with an officer of USCIS and she reported electronically to Nebraska about this problem, we send just in case last Friday again all the documents with the I-140 we don't know what evidence they need, but the thing is that we have to wait ; we don't have a lawyer everything was fine the only problem was that we never received a letter about the I-140 because the address omit the suite number do you think that no matter what we have to find a lawyer ...or just wait... the adjusment was submit in May 2006.

Last year, When I filed I-485/EAD/AP, I wrote the check in favor of DHS (abbreviated) and it was accepted.

Congradulations again to all those IV memeber who are getting Green card approvals and goodluck to all those members who are able to file their I485 and get EAD, just to be out of H1B /H4 clutches and one more step closer to green card
As current drastic visa movment proved the fact that for IV members main issue is not current law but itz implimentation. a change in law will certainly help, but thatz not our big problem
I would like to discuss your IV future agend with current situation, Please post your opinion how you think IV should procede based on current situations.
I belive IV should now concentrate more on making sure current law is implimented in a more effeciant way, make sure USCIS does not waste any visa numbers, we need to push for speeding citizenship processes and makeup for loss time during retrogression
IV should stop chasing CIR which has nothing for us and itz very controversial
IV is for legals and we should concentrate only on whatz good for us

Hello,
I am currently on H4 visa and I am planning to pursue an MBA program. If i choose to study in H4, i know i qualify for the California resident fee discount. If i change my visa to F1 for studies, would i not be eligible for the california resident discount? or would i lose the residency status?

I'm working in Company 'A'. My company is filing for H1 extension for me along with my wife's H4 Extension in the month of April (before that it is not possible it seems - according to lawyer or Imm. dept of company 'A')
Company 'B' is filing H1 visa for my wife on April 1st.
So my question is: Is there a RISK to file 2 separate petitions (H4 Extension and H1) in the same time frame?
If yes, what's the option?
If no, should I say to my employer or lawyer (Company 'A') to not to file H4 extension for my wife because of the overlap of time frames?
