I think cash for clunkers did this GDP increment, to an extent artificial. But still banks are reluctant to give loans to small business. Let us hope consumer spending increases next year leading to the natural increment of GDP

Can someone let me know if we can go a PCP and take medication for INH for 9 months for a positive skin test and negative x-ray.
Or it is a rule that we need to go only to local county health dept.

PCP should be ok. Make sure you get a letter from your PCP after the completion of treatment.

Would going to Canada and re-entering without going for visa stamping count as lawful entry??

Yes (assuming you stayed in Canada for less than 2 weeks or whatever is that number).

Or one has to go and get the visa stamped to qualify as lawful entry??

Also when you go to Canada and come back Without VISA stamping, he gets the same I-94 or different I-94??

If you did not submit your old I-94 at the time of entering canada, then you keep the same I-94. In fact, if you do not have a valid visa stamp (i.e., you are entering using visa revalidation), then it is best not to submit your current I-94.

Your mother can file a B-2 extension request on an I-539. She should not need to file an Affidavit of Support, just provide reasons why she wants to extend beyond the initial admission period. In my experience, CIS is very generous in granting extensions of visitor status. It my take a few months to get an approval. However, as the previous poster says, she can stay in the US while the extension is pending IF the extension is filed before her current status expires. Good luck.

It is not a problem with EAD. I am on H1B. I have already received 2 temp. driving certificates. I am expecting one more temp. certificate before getting the original plastic card. The DMV officials told me that there are lot of immigrant people from India, China and Mexico. So the under-staffed dept requries more time to validate.

Basically, I think your labor can be re-appealed but it is a waste of time. It's better to work with your lawyer and get the job duties tick and tied with the paper filing. Nowadays there are lots of audit in the PERM system.

I'm on H1 and My spouse is on H4 (came on H4 in Dec 2003)
We are both Canadian PR's. I worked out a deal with my US based to company so that I work in Canada and come to USA occasionally.

Here are a few questions regd my spouse


Planning to apply for H1 in April 2007, Once H1 is approved
-Can we use automatic revalidation to enter USA without getting our visa's stamped. My h1 expired in 2006 and my spouse;s H4 expired in 2006.
(remember my spouse is applying for H1 )
-How safe it is FrequENTLY travel to Canada and back
-How safe it is to stay in Canada for duration of 3-6 months and come back to USA
-Once my spouse gets the H1 approved, should he move to H1 immediatly or can continue on H4?
-stamping of H1 (first stamping for H1 in Canada) after conversion from H4

I am on L-1 Visa. My company is ready to apply green card and H1 visa as well. If my green card application is filed, then change in my visa status L1 to H1 is going to impact to my green card application?

In case I apply H1 from other employer, in that case what would be the impact on my green card application?

Friends,

I am in the 8th year of H1b and I have been juggling this idea of changing my job because of a sucking work environment. I have Eb3 labor(it was applied in eb3 even though my job required and i had the eb2 experience) approved and 140 approved so can I get 3 year extension by changing my job or do you suggest to first get 3 year extension and then change, in which case will I still get 3 year extension is the question.

After job change can I use old PD ? Can I apply EB2 perm after changing job ?

I know these are testing times for many of us but i will appreciate your ideas and responses.

Given the current circumstances, it will take years for I-485 to be
process for 02-july filers.

One of the provisions of AC-21 is that the job is in same or similar
occupation. If a person changes his functional role(Ex: IT->marketing,
IT->Non-IT, IT->Sales etc.), how is AC-21 protoability applied ?

So, in this case, can a new labor/I-140 be applied for the NEW
position ? Can this I-140 be used to replace the existing I-140
with USCIS ? Can I-485 continue in this case ?
