Hi .. I am on L1 with my current employer. I applied H1B through a consultancy and my petition got approved. My current employer told me that they can transfer my approved H1B to them. Is it really possible to transfer H1B to my current employer, just by having the approved petition?

Yes transfer is possible. However your current employer's h1b petition also
needs to be approved (RFEs replied to etc).

Last week I visited the cutter Dallas in a shipyard in Charleston. The Dallas, and her sister ship Gallatin, are undergoing extensive work to repair major structural and machinery problems that are the result of their age and overuse. The national security cutter program will replace these 40-year old, Vietnam era vessels with modern, capable ships to secure America.

In Wednesday's seizure off the coast of Guatemala, the crew of the Bertholf disrupted four drug smuggling speedboats at the same time with their multiple pursuit boats and helicopter. The crew successfully captured two vessels and four suspects while disrupting the other two boats.

The continued renewal of the Coast Guard fleet and use of modern technology across the department is an indispensable part of our strategy to improve the ability of DHS to secure our nation and protect its citizens.

Is it enough to get 3 year extension with courtesy copy of I140 approval ? I am asking this because my company has just given the courtesy copy.
Also I understand that the old Eb3 PD can be used to get extension(how can employer revoke approved labor certification ??)

A quick question for all you experts out there

My wife is on H4 right now and I am on H1, though we got our EAD last year, but I am still using my H1 and not used my EAD yet, So is it possible to apply for Social Security for my wife, will applying for Social Security Number, considered as using EAD and H1 becomes void.

Use of EAD to get SSN is OK. Don't use EAD for work.

Hello everyone,

According to my immigration-lawyer, I have received a notice for interview. I filed under EB2 category and only my and my wife's I-485 is pending. I had friends who got their GC without the interview, but i got called of an interview, so I was wondering why i got called for an interview-any specific reasons that some of us get called for an interview?

Another questions is; i read some blogs and almost all the people who were called for an interview seem to get a list of documents from the INS to take along for the interview. My attorney didnot mention anything about the list, so do all interview notices come with the document list or is it normal to not have one?

Please any insight in this matter would be greatly appreciated.

Sorry to hear about your upcoming hardship..
I 've had a similar situation recently - where my H1B (with employer A) was about to expire and then another employer (B) had to recruit me, they filed for transfer+extension.
In I129 while filing, they would have to select (cant recall the exact verbiage) new employer (related to transfer) AND extension of current status. Its better to file this kind of petition premium. I got the new approved petition within 2 weeks with new expiry date as +2yrs, with start date earlier than the H1B expiry date (with A).

I came to us on H4 in 2007 and the got my H1B in 2008. I am not getting a job on H1 yet so i want to know that till when the H1B be valid as I am not genarating any salery and my consultant is not running my pay roll ?

What if the case is where I want to take up a new full time position and convert my current full time position to part time.....I guess one way to do it would be to transfer H1 to the new employer...wait for an approval and then file for another concurrent H1 for the part time job with the old company..But the problem is I'd have to wait until new approval comes...and also convince both companies to shell out 2k plus in filing fees....does any one have a better alternative ? Thanks again

I believe that to convert a full time position to part time, all you have to do is re-file your LCA.

Folks,

I am on EB3 with 140 approved. My PD is Dec 2002. My company is ok to give me a promotion and re-apply on EB2. I have roughly 8 years of experience as a software engineer. According to my company's lawyer I may still have a problem because my university education is not in computers. I have 3 years degree in mathematics (BSc) and 2 years in business (MBA). I also have 2 years diploma in computers.

Anybody has any experience with such a case? Any suggestions or ideas?

What is the risk if I decide to take a chance ?

Hello everyone,
I have a question which I hope someone can help answer.I have applied in EB2 category and am from India.My PD is July 2005. I have used AC21 recently and changed my employer(i.e I am no longer with my sponsoring employer) I have not notified USCIS of the same.

I plan to travel to India during September 2008 and use AP to reenter back into the US. Can someone help answer the below doubts.

1) Since at the port of entry the Immigration Officer will ask whether I am still with the same employer or not- I will have to say I have moved to another company- What happens then?

2)Does using the AP and subsequent answer of "Yes- I have changed my company" trigger a RFE during the GC allocation process since now I have to prove to USCIS that my job is "same or similar" and my pay is >= the pay mentioned in my LC.

3) Has anyone successfully used AP after using AC21 and not had an RFE issued during GC allotment?

You are not supposed to work on EAD until unless it�s renewed that is sure, you can work on H1B for your H1B employer if H1B is not revoked.
I suggest a attorneys advice on H1B once.
